У 2016 році в рамках реалізації Плану заходів Робочої групи (Панелі) «Реформа державного управління» Тематичної платформи 1 «Демократія, належне врядування та стабільність» в рамках ініціативи ЄС «Східне партнерство» на 2016 рік було проведено 5 заходи:

  • міжнародна науково-практична конференція «Професіоналізм, етика та цінності державної служби: досвід країн ЄС та країн ініціативи ЄС «Східне партнерство» (18-19 лютого 2016 року, м. Київ, Україна);
  • міжнародний форум «Взаємодія та співпраця органів державної влади та громадськості в рамках реалізації Угоди про асоціацію в країнах Східного партнерства» (30 червня-1 липня 2016 року, м. Київ, Україна);
  • Восьмі щорічні Рішельєвські академічні читання на тему: «Актуальні питання впровадження нового законодавства про державну службу» (22-23 вересня 2016 року, м. Одеса, Україна);
  • Десята щорічна регіональна конференція з питань інституційної розбудови (17-18 листопада 2016 року, м. Київ, Україна);
  • тренінг «Організація та проведення компетентнісно орієнтованого інтерв’ю (структуроване інтерв’ю, STAR, PARLA) і оцінки персоналу за методиками «Assessment Center» та «360 градусів» (14-16 грудня 2016 року, м. Київ, Україна).

Водночас протягом 2016 року НАДС взято участь у таких заходах, проведених в рамках Робочої групи (Панелі):

  • семінарі «Розроблення системи підвищення кваліфікації з метою подолання викликів та загроз на державній службі» (15-16 червня 2016 року, м. Єреван, Республіка Вірменія);
  • семінарі «Державні службовці вищого корпусу: роль та обов’язки» (21 жовтня 2016 року, м. Кишинів, Республіка Молдова);
  • навчальному семінарі «Загальна оцінка результатів службової діяльності, винагороди та бонуси» (10-11 листопада 2016 року, м. Тбілісі, Грузія).

Крім того, взято участь у засіданнях Тематичної платформи № 1 «Демократія, належне врядування та стабільність» в рамках ініціативи «Східне партнерство»:

  • Десятому засіданні Робочої групи (Панелі) «Реформа державного управління» (2-3 червня 2016 року, м. Баку, Азербайджанська Республіка);
  • Одинадцятому засіданні Робочої групи (Панелі) «Реформа державного управління» (6-7 жовтня 2016 року, м. Варшава, Республіка Польща).

У 2015 році в рамках реалізації Плану заходів Робочої групи «Реформування державного управління» тематичної платформи 1 «Демократія, належне врядування та стабільність» в рамках ініціативи ЄС «Східне партнерство» на 2015 рік було проведено 3 заходи:

  • конференцію на тему: «Взаємодія органів державної влади та громадськості в рамках реалізації Угоди про асоціацію» (14-15 травня 2015 року);
  • VII щорічні Рішельєвські академічні читання «Управління людськими ресурсами на державній службі: нові підходи та технології» (24-25 вересня 2015 року, м. Одеса);
  • Дев’яту щорічну регіональну конференцію з питань інституційної розбудови (12-13 листопада 2015 року).

Водночас протягом 2015 року Нацдержслужбою взято участь у таких заходах, проведених в рамках Робочої групи:

  • конференція «Етика в галузі державного управління» в рамках проекту «Розвиток системи професійної етики в галузі державного управління» (27 березня 2015 року, м. Бухарест, Румунія);
  • конференція «Підвищення ефективності державної служби: загальна система оцінювання та безперервне навчання» (26 травня 2015 року, м. Єреван, Республіка Вірменія);
  • міжнародна конференція «Розвиток спроможності під час реформи державного управління» (09-10 липня 2015 року, м. Баку, Азербайджанська Республіка).

Крім того, взято участь у засіданнях тематичної платформи № 1 «Демократія, належне врядування та стабільність» в рамках ініціативи «Східне партнерство»:

  • 8 засіданні Робочої групи (04 червня 2015 року, м. Стокгольм, Королівство Швеція);
  • 9 засіданні Робочої групи (22 жовтня 2015, м. Вільнюс, Литовська Республіка).

Тематична платформа 1 «Демократія, належне врядування та стабільність»/“Democracy, Good Governance & Stability” спрямована на сприяння демократичним та економічним реформам у країнах-партнерах Східного партнерства. Її метою є розвиток стабільних демократичних інститутів (включаючи стандарти виборчого процесу, законодавство щодо засобів масової інформації, антикорупційні заходи) та ефективних державних структур. Цілями цієї платформи є безпека, забезпечення стабільності суверенітету та територіальної цілісності країн-партнерів шляхом реалізації багатосторонніх заходів, спрямованих на зміцнення довіри та створення систем своєчасного попередження.

З 2011 року Україна в особі НАДС приймає активну участь у сферах діяльності Робочої групи (Панель) «Врядування та реформа державного управління» Тематичної платформи 1 «Демократія, належне врядування та стабільність» в рамках ініціативи ЄС «Східне партнерство», зокрема на постійній основі бере участь у засіданнях Робочої групи (Панелі) та у заходах, організованих країнами-членами Східного партнерства. Співпраця в рамках зазначеної Робочої групи (Панелі) сприяє виконанню поставлених перед НАДС завдань, зокрема забезпеченню формування та реалізації єдиної державної політики у сфері державної служби, здійсненню функціонального управління державною службою, розробленню заходів щодо підвищення ефективності державної служби та ін.

Діяльність Робочої групи (Панелі) спрямована на такі напрями:

  • «Державна служба, державні установи та їх функції (управління людськими ресурсами, загальні засади прийняття та проходження державної служби, нормативно-правові акти)»;
  • «Прозорість, електронне урядування та захист даних»;
  • «Децентралізація місцевих/ регіональних органів державної влади»;
  • «Ефективне управління технічною допомогою».

З 2012 року Україна є країною-лідером у сфері «Ефективне управління технічною допомогою». Щороку НАДС готує та затверджує разом з партнерами Східного партнерства план заходів на відповідний рік у чотирьох згаданих сферах.

The Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Ukraine, of the other part (hereinafter – Association Agreement between Ukraine and the EU), concluded on June 27 and ratified on September 16, 2014, provides for large-scale institutional and structural reforms in line with the established framework.

The consistent and effective implementation of the Association Agreement between Ukraine and the EU should create a solid basis for the further sustainable political and economic development of our country, to become the basis for a strategy for reforming all key areas of public administration and the implementation of European standards in order to improve the quality of life of the population.

Effective public administration involves the ability of the state to provide administrative services and ensure its economic growth and competitiveness on the international scene.

The reform of the civil service largely determines the success and other reforms, the results of which directly depend on the quality of managerial decisions of state bodies.

The obligation to reform public administration, in particular the civil service, as soon as possible, is established in the Strategy for Sustainable Development “Ukraine – 2020” and the Program of Action of the Cabinet of Ministers of Ukraine.

Legislative consolidation of the new principles of the civil service, harmonized with European principles, is one of the tasks of the Action plan to implement the Association Agreement between Ukraine and the EU, approved by the Decree of the Cabinet of Ministers of Ukraine of October 25, 2017 No. 1106, and Legislative Plan of Reforms in Ukraine, approved by the Resolution of the Verkhovna Rada of Ukraine of June 4, 2015 No. 509-VIII.

Civil service reform should ensure its new quality in line with best European practice. The priorities of civil service reform are:

  • building of professional, non-corrupt, prestigious civil service, which is oriented to the needs of citizens;
  • separation of policy from administration;
  • introduction of a competent human resources management model;
  • harmonization of civil service and service in local self-government bodies;
  • introduction of a transparent model of remuneration and career motivation of civil servants;
  • staffing of the decentralization process.

To fulfill the obligations set out in the Association Agreement between Ukraine and the EU, and according to the results of the assessment of state of play in public administration system of Ukraine, which was held in 2018 by the SIGMA program experts, and audit of the comprehensive reform of public administration, which was held by the Accounting Chamber of Ukraine, and taking into account consultations with the interested parties, and in cooperation with the state authorities, including with the NAUCS, and with the participation of the EU Delegation in Ukraine, international experts and representatives of the public, the Cabinet of Ministers of Ukraine by the Resolution of December 18, 2018, No. 1102-r approved a new version of the Strategy of the Reform of Public Administration of Ukraine for the period until 2021 and the Action plan for its implementation for 2019-2021, which were approved by the Resolution of the Cabinet of Ministers of Ukraine of June 24, 2016, No. 474-r.

The said Strategy meets the European standards of good governance and the SIGMA Program’s European principles of public administration.

Also, with the participation of the EU experts, the SIGMA program and representatives of the public was provided with the development and adoption of the Law of Ukraine “On Civil Service” of December 10, 2015, No. 889-VIII, which entered into force on May 1, 2016.

In order to effectively implement the new model of civil service and the Law of Ukraine “On Civil Service” of December 10, 2015, No. 889-VIII, NAUCS, in cooperation with international experts, in particular SIGMA experts, has ensured the adoption of all substatutory acts determined by the said Law, among which:

  • Regulation on the Commission on Senior Civil Service;
  • The procedure for holding a competition for civil service positions;
  • Typical requirements for persons applying for civil service positions of category "A";
  • The procedure for determining the special requirements for persons applying civil service positions of categories “B” and “B”;
  • Procedure for conducting attestation of persons applying for admission to the civil service for the fluency in the state language;
  • Typical procedure for the civil servants performance appraisal;
  • Typical regulation on the personnel management unit of a public authority;
  • The issues of remuneration of civil servants.

At the same time, it is necessary to introduce technical amendments to the Law of Ukraine “On Civil Service” of December 10, 2015, No. 889-VIII (hereinafter – the Law). In this regard, the NAUCS, in cooperation with the public, representatives of stakeholders, international and domestic experts, has developed a draft Law of Ukraine "On Amendments to the Law of Ukraine" On Civil Service” to clarify certain provisions of the Law. The said draft law was approved by the Government on March 22, 2017, and submitted to the Verkhovna Rada of Ukraine on March 23, 2017 (Reg. No. 6227).

Also, in June 2016, was formed and started to work the Commission on Senior Civil Service, which includes 12 members, representatives of all branches of power of Ukraine, and also 4 representatives of public associations, scientific institutions and educational institutions.

For the proper and transparent organization of the competitive selection process for civil service positions, a web-portal of public service vacancies https://career.gov.ua/ is created and functioning. Information on the announcement a competition for vacant civil service positions and the results of the conducted competitions is also available on the website http://www.nads.gov.ua/.

At the same time, in order to ensure the definition of the optimal number of civil servants, taking into account the functions and organizational structure of state bodies, optimizing the number of employees of the state bodies, the NAUCS in 2016, in the test mode, launched an automated data collection portal on the quantitative composition of civil servants – ksds.nads.gov.ua. The online data collection system, developed for the first time in Ukraine, operates almost in real time and covers 898 state agencies (129 state bodies and 769 judiciary authorities). The development and implementation was carried out by the NAUCS with the help of iGov teams and the Project Office of the National Council for Reforms, without the cost of public funds.

Also, by the order of the NAUCS of October 21, 2016, No. 223 was approved the reporting form of the QCCS (quarterly) “Report on the quantitative composition of civil servants” and the Instruction on its filling (registered by the Ministry of Justice of Ukraine on November 14, 2016, No. 1477/29607).

Definition of the actual number of civil servants is conducted on a quarterly basis (QCCS system).

In addition, in order to ensure efficient human resources management in the field of civil service, control over employment in the civil service, promoting transparency of staff costs with the support of the World Bank was developed the Concept for implementation of the human resources management information system in the state bodies and the plan of measures for its implementation, which was approved by the Resolution of the Cabinet of Ministers of Ukraine of December 01, 2017 No. 844-r.

The Concept defines the directions, mechanism and timing of implementation of the Human Resources Management Information System (HRMIS) in state bodies.

In order to ensure the effective implementation of the civil service reform, discussion of problems and challenges in its implementation, the dissemination of best practices in the personnel management in state bodies and the development of practical recommendations, the Council for the Civil Service Human Resources Management of under the NAUCS was established (Order of the NAUCS of December 07, 2017 No. 248), which will include the heads of the personnel management units of central executive bodies.

In addition, in order to achieve the objectives of the Strategy, the NAUCS developed the Concept of Creation of a Team of Specialists on Reforms, approved by the Resolution of the Cabinet of Ministers of Ukraine of November 11, 2016 No. 905-r.

In order to ensure coherence, efficiency and effectiveness of the implementation of the state policy in the respective areas, the preparation and implementation of specialists in national reforms, ensuring accountability and transparency of the state executive bodies, as well as for the purpose of implementation in the work of the state bodies of modern tools of operational monitoring of the number of employees of state bodies and their wage costs the Strategy provides for a carrying out a functional review in ministries and others state executive bodies.

In accordance with the plan of measures for implementation of the Strategy in 10 ministries established by the Cabinet of Ministers of Ukraine as pilot, by the working groups, headed by their leaders and / or state secretaries, formed by the Cabinet of Ministers of Ukraine, a functional review was conducted. According to the results of functional review, the determined missions, goals and areas of government policy in these ministries, relevant directorates responsible for one / several areas of government policy were created.

Conducting a functional survey of ministries identified by the Cabinet of Ministers of Ukraine as pilot, helped optimize the internal organizational structure of ministries, by separating in their apparatus the structural units responsible for the quality of state policy formation, strategic planning and coordination of the implementation of the relevant policy (directorates), and facilitated the recruitment of (updated) staff to the positions of reform specialists.

In addition, the NAUCS developed the Concept of Optimization of the Central Executive Bodies System, approved by the Resolution of the Cabinet of Ministers of Ukraine of December 27, 2017 No. 1013-r (amended in accordance with the Resolution of the Cabinet of Ministers of Ukraine of December 18, 2018, № 1102-r).

The Concept defines the guidelines for the organization of the ministries and other central executive bodies’ activities.

Also, currently, is carrying out the harmonization of the Law of Ukraine “On Civil Service” of December 10, 2015, No. 889-VIII, and the draft Law of Ukraine “On Service in Local Self-Government Bodies” (Reg. No. 8369 dated May 17, 2018), developed by the NAUCS.

First of all, this will mean that in the general issues of service in local self-government bodies will apply the same approaches as in state bodies.

Planned results of the reform:

  1. Improving the quality of public services. Services will be provided by competent staff.
  2. Depoliticized, stable and professional service, oriented to citizens in order to perform tasks in the interests of the state.
  3. Attraction of talented citizens.
  4. Transparent and accountable to civil society civil service.

In the end, citizens’ confidence in the bodies and state institutions will grow, which is the mainstay of the success of reforms.

On February 18-19, 2016 at the premises of the National Agency of Ukraine on Civil Service (hereinafter – the NAUCS) the two-day international research and practical conference “Professionalism, Ethics and Values of Civil Service: Experience of the EU Member States and Eastern Partnership Countries” (hereinafter – the Conference) was held. The event was organised by the NAUCS and the Center for Adaptation of the Civil Service to the Standards of the European Union within the framework of the Working Group (panel) “Public Administration Reform” of the thematic platform “Democracy, Good Governance and Stability” of the EU initiative “Eastern Partnership”.

In the framework of the event the topical issues and implementation of the best EU Member States and Eastern Partnership Countries experience and practices regarding the formation of the effective, transparent and open civil service in accordance with the principles of good governance and on the basis of the ethical norms and values was discussed. 

During the first day of the conference the Head of the NAUCS Kostiantyn Vashchenko in his opening remark underlined the importance of the civil service reform based on the European standards and best international experience in the public administration reform.

Head of the Delegation of the European Union to Ukraine Jan Tombinski noted the extraordinary relevance of the chosen topic and emphasized the reform of public administration and the establishment of public, professional, politically impartial, effective, citizen-oriented civil service, which operates in the interests of the state and society are among the priorities identified by the Association Agreement between Ukraine and the European Union.

Dmytro Shymkiv, the Deputy Head of the Presidential Administration of Ukraine, emphasized that the creation of an integrated civil service is an important legal definition of rules of ethical conduct for civil servants, their knowledge and establishment of responsibility for its compliance.

Furthermore Dmytro Shymkiv underlined that within the context of public administration reform continuous professional competency development of civil servants on ethics and preventing corruption, creation of online resources and study cases for practical acquisition of knowledge, skills and abilities was considered to be quite essential.

The Minister of the Cabinet of Ministers of Ukraine Hanna Onyshchenko admitted that legal definition of either landmarks or specific requirements to the behavior of civil servants would enhance the effectiveness of interrelation between government authorities and civil society as well as would facilitate realization of rights and freedoms of a human being and the citizen, envisaged by the legislation, and guarantee commitment of civil servants to supreme moral principles and the state. 

The Head of the Project of Hanns Seidel Foundation in Ukraine, the Republic of Moldova and Romania Daniel Seiberling in his speech underlined the importance of civil service reform, updating objectives of personnel services, as well as the necessity of the level of their professional competency on human resources management.

Yurii Kovbasiuk, the President of the National Academy for Public Administration under the President of Ukraine stated the importance of involvement of talented youth to the civil service and creation of conditions for their professional development as well stressed on the key role of the National Academy for Public Administration under the President of Ukraine for creation of such conditions, update of standards of high education and study programs.

Within the frameworks of panel discussions and work in sections durind the first and the second day of the conference representatives of the EU Member States and Eastern Partnership countries, governmental authorities of Ukraine, international and public organizations, higher educational institutions and centers for training and professional development of personnel got the opportunity to familiarize and discuss  the novations of the Law of Ukraine “On Civil Service”, to exchange the experience and best practices of the EU Member States and the Eastern Partnership countries regarding the objective recruitment and promotion, motivation of the fair behavior and ethics of the civil servants.

According to the results of the Conference the common position document was elaborated.

On February 9, 2016 at the premises of the State Fiscal Service of Ukraine the Twinning project kick-off «Support for State Fiscal Service of Ukraine in the development of integrated border management" was held.

The project is implemented by the State Fiscal Service of Ukraine together with the Germany Federal Ministry of Finance, Customs Service under the Ministry of Finance of the Republic of Poland and Customs Department under the Ministry of Finance of the Republic of Lithuania. 

The aim of the project to establish a basis for effective customs management and integrity in Ukraine based on IBM principles. 

In a welcome speech the Head of the State Fiscal Service of Ukraine, BC Project Leader Roman Nasirov, underlined the importance of the implementation of IBM elements and revision of the national anti-corruption legislation, not only for the beneficiary but the whole country.

The Head of Cooperation of EU Delegation to Ukraine Berend de Groot welcomed the participants and expressed readiness European side to the comprehensive support of the project. 

Arunas Adomenas, Junior Project Leader from the Republic of Lithuania, Jerzy Chrobak, Deputy Director of the Customs Service under the Ministry of Finance of the Republic of Poland, Julian Wurtenberger, Director of Customs of the Federal Ministry of Finance of Germany also delivered their speeches during the event. 

The Project Leader Rainer Brussels expressed the gratitude for the confidence to the consortium to implement the Twinning project. Detlef Schesny, the RTA, made a review of the planned measures under three components of the Twinning project and summarized the measures implemented. 

Ambassador Extraordinary and Plenipotentiary of the Federal Republic of Germany, representatives of the Embassies of the Republic of Poland and the Republic of Lithuania, representatives of the public authorities of Ukraine, international organizations, foreign experts and mass media took part in this event. 

Senior consultant of the Administrative Reform Projects, Sigma and CIB Division of the Projects Management Unit of the Center for Adaptation of the Civil Service to the Standards of the European Union Viktoriia Nazarenko attended the event. 

For reference: since 2005 according to the Decree of the President of Ukraine dated on October 6, 2005 № 1424/2005 «The Issue on the Twinning Programme Implementation in Ukraine» the National Agency of Ukraine on Civil Service directs and coordinates the activity on preparation and implementation the Twinning Programme in Ukraine. Moreover the NAUCS is considered to be the national coordinator of the institutional building instrument TAIEX and CIB Programme according to the relevant regulatory acts.

On February 1, 2016 at the premises of  Delegation of the European Union to Ukraine the selection meeting of the partners for Twinning project «Support to the State Border Guard of Ukraine in further development IBM approaches for travel documents verification and of stolen vehicles detection" for the Administration of the  State Border Guard Service of Ukraine (hereinafter - SBGS).

The abovementioned Twinning Project implementation presupposes improve the level of prevention of illegal migration and combating crime in Ukraine by establishing an integrated border management system.

During the meeting some proposals regarding prospective cooperation within the framework of the Twinning project which had been received from a consortium of the countries including the Federal Republic of Germany, the Lithuanian Republic and Polish Republic.

Ambassador Extraordinary and Plenipotentiary of the Federal Republic of Germany to Ukraine Christof Weil, representatives of the Embassy of the Republic of Poland in Ukraine and the Embassy of Lithuanian Republic in Ukraine, the Head of the Regional Department of Federal Police of Germany in Hannover, representatives of the - SBGS and the EU Delegation to Ukraine took part in this event. Senior consultant of the Administrative Reform Projects, Sigma and CIB Division of the Projects Management Unit of the Center for Adaptation of the Civil Service to the Standards of the European Union  Viktoriia Nazarenko attended the meeting.

On February 3, 2016 the Head of National Agency of Ukraine on Civil Service (hereinafter – the NAUCS) Kostiantyn Vashchenko was on working meeting with the project manager of Hanns Seidel Foundation in Ukraine, the Republic of Moldova and Romania Daniel Seiberling as well as the Foundation Director in Ukraine Sergii Zagornyi concerning further cooperation in the development of human resources management system on the civil service in Ukraine.

The main purpose of the meeting was to discuss the importance of a comprehensive public administration reform in Ukraine, guaranteeing the professional and political impartiality of civil servants, institutional stability and the creation of conditions for transparency of government agencies.

The Head of the NAUCS thanked colleagues for their support and highly estimated the results of joint activities, in particular pointed out that the organization of training for the Heads of personnel departments of central executive authorities of Ukraine. Furthermore, Kostiantyn Vashchenko noted that with the adoption of the new Law of Ukraine “On Civil Service” by the Verkhovna Rada such cooperation is of key importance because it is impossible to provide comprehensive and efficient  innovations in the implementation of the legislation without the best European practices in the daily activities of government authorities.                      

Taking into account the tasks of a fundamental restructuring of HR management on the civil service, the strategic framework for future cooperation were defined. Additionally, the specific steps to ensure implementation of the European principles of HR management system in the civil service in Ukraine were discussed.

The Director of the Center for Adaptation of Civil Service to the Standards of European Union Maryna Kanavets, the Chief Specialist of the International Cooperation Sector of the Unit of the Strategic Planning, Information and Analytical Support of the NAUCS, Yuliia Iarko and the representative from Hanns Seidel Foundation Office in Ukraine Olena Maksymova took part in the meeting.
