Ensuring Equal Access to Civil Service for Women and Men

According to the article 4, paragraph 1, subparagraph 7 of the Law of Ukraine “On Civil Service” as of 10 December, 2015 No 889-VIII, an ensuring equal access to civil service is one of the civil service principles, that is prohibition all forms or manifestations of discrimination, lack of excessive restrictions or providing undue advantage for certain categories of persons.

Advance Training on the Gender Equality Framework of Civil Servants and Employees of Local Self-Government Authorities

In 2018 the Action Plan for implementation of the Concept for reforming the system of professional training of civil servants, heads of local state administrations, their first deputies and deputies, officials of local self-government and local councils (hereinafter – Action Plan) was approved by the Resolution of the Cabinet of Ministers of Ukraine as of 10 May, 2018 No 342, which provides for development of programmes for special short-term training courses, seminars, trainings, modules for training programmes of civil servants, heads of local administrations, their first deputies and deputies, local government officials and local councils, including the gender policy.

In implementation of measures 1 and 2 of tasks 5 and 6 of the State Social Programme on providing Equal Rights and Opportunities for women and men for the period up to 2021, approved by the Resolution of the Cabinet of Ministers of Ukraine as of 11 April, 2018 No 273 “On Approval of the State Social Programme on Ensuring Equal Rights and Opportunities women and men for the period up to 2021”, the NAUCS within the authority has given recommendations to the National Academy for Public Administration under the President of Ukraine, centers for retraining and advanced training for representatives of government authorities, local self-government authorities, state enterprises, institutions and organizations, the All-Ukrainian Center for the Training of Civil Servants and Local Self-Government Officials to prepare the modules and topics within the scope of the United Nations Convention on the Elimination of All Forms of Discrimination against Women on ensuring equal rights and opportunities of women and men taking into account contemporary international documents and recommendations of international monitoring bodies, and to include it into short-term professional development programmes for civil servants and local self-government officials with providing continuous training (official letter of NAUCS as of 4 May, 2018 No 84/70/22-18).

At present, the National Academy for Public Administration under the President of Ukraine and its regional institutes, district and regional centers for retraining and advanced training for representatives of government authorities, local self-government authorities, state enterprises, institutions and organizations have included the gender policy issue to varied components of training programmes for civil servants and local self-government authorities officials on following topics:

 “Fundamentals of State Policy in the Sphere of Prevention and Counteraction of Discrimination”;

“Counteraction of Discrimination and Overcoming Gender Stereotypes”;

“Principles of Prevention and Counteraction of Discrimination in Ukraine”;

“Concept and Problems of Gender Policy”;

“Modern Approaches to Providing Gender-Sensitive Social Services”;

“Implementation of Gender Approaches in the Activities of Public Authorities: Ensuring Equal Rights and Opportunities for Women and Men”;

“Interpretation of the Law of Ukraine “On Principles of Prevention and Counteraction of Discrimination in Ukraine” etc.

During 2018, 1032 civil servants and local self-government officials, as well as 444 specialists on gender equality issues, were trained in corresponding programmes.

At the same time, the advanced training regarding the basis of gender equality for 3748 civil servants and local self-government officials was organized in 2017.

On 16–17 October, 2018 the All-Ukrainian Center of Advanced Training of Civil Servants and Local Self-Government Officials conducted the thematic short-term seminar “Gender Equality in the Civil Service”.

Thematic meeting with the Government Commissioner for Gender Equality Policy Kateryna Levchenko was held within the framework of the seminar. She introduced to the participants of the event the peculiarities of gender policy in Ukraine at the modern stage.

During the seminar, the participants discussed the fundamentals of gender theory, ethical aspects of gender self-realization of a civil servant, as well as legal aspects of gender policy in Ukraine in the framework of fulfilling international obligations.

Representatives of the Verkhovna Rada of Ukraine, the Secretariat of the Cabinet of Ministers of Ukraine, the Secretariat of the Constitutional Court of Ukraine, the Ministry of Internal Affairs of Ukraine, the Ministry of Ecology and Natural Resources of Ukraine, the Ministry of Economic Development and Trade of Ukraine, the Ministry of Youth and Sport of Ukraine, the Ministry of Defense of Ukraine, the Ministry of Education and Science of Ukraine and other state authorities in the amount of 51 persons took part in the event. All participants received certificates of advanced training upon completion of the training.

Furthermore, on 23 October, 2018, the one-day thematic short-term seminar on “Gender Equality in the Civil Service” with the participation of representatives of the UN Women Ukraine was held for members and employees of the Division for the Support of the Senior Civil Service Commission.

Communicative measures

On 24–25 October, 2017, the module of the Information Orientation Course on Euro-Atlantic Integration devoted to the theme of leadership and gender was held on the basis of the Hennadii Udovenko Diplomatic Academy of Ukraine and the Ministry of Foreign Affairs of Ukraine within the framework of the NATO–Ukraine Programme for Professional Development of Civilian Personnel in Security and Defence Sector of Ukraine.

The participants of the module discussed the gender issues, the gender equality issues in the sphere of peace and security, in particular, the successful examples of the implementation of the National Action Plan for the Implementation of United Nations Security Council Resolution 1325 on Women, Peace and Security (UNSCR 1325), the main aspects of gender mainstreaming, the implementation of the principles of UNSCR 1325 in NATO and the gender budgeting.

27 and 28 September, 2018 the seventh module “Gender Equality in the Center of Reforms” of the project “Champions 100” aimed at the mastering the knowledge of gender equality by the participants, the mechanism for ensuring equal rights and opportunities for women and men in all spheres of society and the implementation of European standards of equality was held within the framework of the aforementioned Programme.

The participants of the module had the opportunity to discuss the issues of gender tendencies in the political context of Ukraine, the issue of the importance of adopting draft law on gender equality, the issues of gender in the context of hybrid warfare, and gender responsive budgeting.

On 22 November, 2018 the NAUCS jointly with the Center for Adaptation of the Civil Service to the Standards of the European Union within the framework of the Panel on Governance and Public Administration of the Platform 1 “Strengthening Institutions and Good Governance” of the EU initiative “Eastern Partnership” the seminar “Ensuring Gender Equality in the Public Service” was held.

The event was organized in order to introduce gender equality approaches and practical gender mainstreaming in the activities of executive authorities and local self-government authorities, united territorial communities of the EU Member States and the countries of the EU initiative “Eastern Partnership” as well as to discuss highly relevant issues and best practices on ensuring gender balance in the civil service and service in local self-government authorities, implementation of equal rights and possibilities for women and men at the central and local levels.

Representatives of the ministries, other government authorities, local self-government authorities of the countries of the EU initiative “Eastern Partnership”, higher educational establishments, that provide professional training for Master’s degree in “Public Administration and Management”, representatives of centers for retraining and advanced training for representatives of government authorities, local self-government authorities, state enterprises, institutions and organizations, civil society institutes, international and Ukrainian experts on equal rights for women and men took part in the event.

The book “Gender Policy in the Public Administration System of Ukraine” which was prepared by the NAUCS jointly with the Center for Adaptation of the Civil Service to the Standards of the European Union was presented within the framework of this seminar.

The book covers the main directions of the formation and realization of the state gender policy in the system of public administration, in particular, the main concepts, essence, current tendencies, best European experience and mechanisms of gender policy development as well as Ukrainian legislation, international acts, the EU legislation and directives in this specific area.

Ensuring Equal Representation Opportunities at the Highest Levels of Decision-Making in Political and Public life

To fulfill the task 5.4 – Gender Equality of the National Report “Objectives of Sustainable Development: Ukraine” the NAUCS keeps a record of the proportion of women among the senior civil service positions (“A” category positions).

* According to the Law of Ukraine as of 09 November, 2017 No 2190-VIII “On Amendments to Some Laws of Ukraine Concerning Certain Issues of Civil Service Career”, starting from 11 November, 2017 the positions of the heads of local state administrations do not belong to the civil service positions of category “A” (senior civil service), and the positions of deputy heads of local state administrations - to the civil service positions of category “B”.

During the second half of 2016, 36 persons were appointed to the above mentioned positions, including 8 women.

During 2017, 101 persons were appointed to the above mentioned positions, including 23 women, that is 27,8%.

In 2018, 21 competitions for holding civil service positions of category “А” were conducted, consequently 18 winners were identified, in particular 6 women and 12 men. Furthermore, according to the results of the competition 11 persons were identified as the second candidate, in particular 4 women and 7 men.

According to the results of the competitions for holding civil service positions of category “А” 15 winners have been appointed, including 4 women.

Furthermore, the number of persons who submitted the documents for participation in the competition is 180 persons, where 141 persons are men and 39 persons are women. The number of people admitted to the competition is 152 people, of which 120 people are men and 32 are women.

However, taking into account the provisions of the Law of Ukraine “On Ensuring Equal Rights and Opportunities for Women and Men”, as well as within the framework of implementation of the “State Social Programme for Ensuring Equal Rights and Opportunities for Women and Men for the Period up to 2021”, the NAUCS has started drafting amendments to the order No 223 “On Approval of the Reporting Form of the QCCS (quarterly) “Report on the Quantitative Composition of Civil Servants” and the Instructions for its Completion”. Amendments to the Order provide for a detailed and extended set of indicators for persons working in government authorities, including gender and age group.

The II (second) quarter of 2019 is considered to be the indicative date for commencing the updated system for collecting statistics on the quantitative composition of civil servants working in government authorities, institutions and organizations, whose positions of leading staff and specialists are classified as the civil service positions. At the same time, State Statistics Service of Ukraine has prepared a draft resolution of the Cabinet of Ministers of Ukraine “Issues of coordinating the data collection for sustainable development goals monitoring”. In addition, the list of tasks and indicators of the sustainable development goals for Ukraine until 2030 provides for the implementation of the NAUCS indicator on the registration of women in the civil service by category of posts “A”, “B” and “C”.

In pursuance of the State Social Programme on ensuring equal rights and opportunities for women and men up to 2021, approved by the Resolution of the Cabinet of Ministers of Ukraine as of April 11, 2018, No 273 “On Approval of the State Social Programme on Ensuring Equal Rights and Opportunities for women and men up to 2021” NAUCS reports to Ministry of Social Policy of Ukraine on the fulfillment of the tasks and activities of the Program every 6 months for its generalization and submission to the Cabinet of Ministers of Ukraine.

At the same time, in pursuance of the National Action Plan to implement the UN Security Council Resolution 1325 “Women, Peace and Security” up to 2020, approved by the Resolution of the Cabinet of Ministers of Ukraine as of February 24, 2016, No 113-r “On Approval of the National Action Plan of UN Security Council Resolution 1325 “Women, Peace and Security Implementation” up to 2020” (in the wording of the Regulation of the Cabinet of Ministers of Ukraine as of September 5, 2018, No 637-r) NAUCS annually provides the Ministry of Social Policy of Ukraine with information on the state of implementation of the National Action Plan for summarizing and informing the Cabinet of Ministers of Ukraine.

Activity of the Expert Council on the Consideration of Applications for Discrimination on the Basis of Sex

A representative of the NAUCS is part of the Expert Council on the consideration of applications for discrimination on the basis of sex, which was established by order of the Ministry of Social Policy of Ukraine as of June 08, 2012, No 345 “On the Expert Council on the consideration of applications for discrimination on the basis of sex”.

An Authorized Person on Ensuring Equal Rights and Opportunities 

for Women and Men

In accordance with Articles 12 and 13 of the Law of Ukraine “On ensuring equal rights and opportunities for women and men” as of September 08, 2005, No 2866-IV, by the order of the NAUCS as of February 21, 2017 No 58/1 of the K/O “On the Determination of an Authorized Person Ensuring Equal Rights and Opportunities for Women and Men in the apparatus of the National Agency of Ukraine on Civil Service”. The Deputy Head of NAUCS, Zabolotnyi Andrii was defined as an authorized person (coordinator) on the issues of ensuring equal rights and opportunities for women and men.

Information and Analytical Support Unit of the Strategic Planning and Policy Analysis Department is responsible structural unit for ensuring equal rights and opportunities for women and men in the apparatus of NAUCS, its territorial authorities and institutions belonging to its sphere of management.
